Would I be right in saying that in cases where a councillor dies after November 22 and was due for reelection in May that the local authority has the option of waiting until May 22nd if no party moves a writ ? Not an option, no by-election will occur. Known as "six month" rule. Indeed. It is statute law, from the Local Government Act 1972 s. 89(3). There is a minor exception allowing byelections to be held within six months of the election if more than a third of the seats on the council are vacant. I doubt that this has ever happened since the reorganisation of local government, although it did occasionally happen before it (when councils were much smaller in number). Clay Cross Urban District Council held an all-council byelection for all 11 seats on 2 March 1974, a matter of days before the council was due to be wound up in the reorganisation, because every member had been surcharged and disqualified.

Clay Cross Urban District Council held an all-council byelection for all 11 seats on 2 March 1974, a matter of days before the council was due to be wound up in the reorganisation, because every member had been surcharged and disqualified Wonder how much that pointless exercise cost - the turnout would have been interesting to see And just a few days after a GE as well

The lucky people of Clay Cross got to vote twice within the space of three days: in the general election on Thursday 28 February, and then in the council byelections on Saturday 2 March. (Then they had to vote in byelections to Derbyshire county council and to the new North East Derbyshire district council to replace the disqualified former Clay Cross councillors who had been elected there)
Actually the turnout on 2 May was very good - 71.5%.

It would not have been possible whilst a Prime Minister had the right to call a General Election at any time but now that we have fixed term parliaments it would be a possibility. I can see scenarios where each of the main parties might be able to take advantage of calling a by election in February or March 2015 therefore if I were Cameron I would be weighing up whether or not to close down the loophole.

Well, amusingly the notice of writ for the by-election has appeared before the notice of resignation. I understand Cllr Catherine Grundy resigned at about 5pm today. The writ was emailed at 6:55pm.

I can well imagine the multitude of issues that crop up there. I suspect I would have waited, but there again, remembering what happened last time there was a two-up in Kingstanding... I can imagine the caseload in Kingstanding is quite substantial, I can also imagine that the 2 remaining councillors are perfectly capable of handling it.

It is with great regret that I advise that Robin Eve OBE (Independent, Cheap Ward, City of London Corporation) has passed away following a long illness. Robin had been Ward Deputy since 2004 and had served as a Common Councilman for over 33 years.

I'd say there's less than meets the eye. Councillor doesn't attend any meetings in six months, so he gets disqualified.

Yes, but rather ridiculously they are claiming complete ignorance of the dispensation rule.Now you would have thought that if you wanted to be an elected Cllr you might want to acquaint yourselves with the rules of er..local government, even by just contacting the legal department.
