Labour probably too strong here for it to actually change anything, but if it was a marginal with the leader of the Council defending, you could bet the opposition would give it a good go in these circumstances.

The same thing happened in Ceredigion last time around. The Lib Dem candidate in Llandyriog died before polling day so the Plaid person was still duly nominated, but when nominations closed the Lib Dems (nor anyone else) fielded a candidate and the Plaid candidate was elected unopposed.

Cllr Carol Baume (Lab, Woughton and Fishermead) died this morning.

She'd previously stood down due to health reasons and I had hoped that her return meant they were behind her. Sadly not. Lovely lady who combined some real steel with a big heart and you always felt she was more interested in you then herself. Will be missed RIP.

We had a postponed poll for Abbots Langley PC a few years ago. Yes, the surviving candidates' nominations stand, but withdrawals are permitted. On that occasion one of the Labour candidates in the five-vacancy election withdrew her nomination papers in favour of the nomination of Mrs ColinJ, who had already stood unsuccessfully in one of the other parish wards on the regular polling day.

The Electoral Commission's guidance says otherwise:

2.147 Where a new election is required after the countermanding or abandonment of a poll due to a candidate’s death, you must select a new day for the poll, and this must fall within 35 working days of the day fixed for the first poll. New nominations can be made, but candidates already validly nominated at the original poll do not have to be nominated a second time. Candidates validly nominated prior to the countermanding or abandonment of the poll may not withdraw as their period for withdrawals has expired.

although annoyingly they don't give a reference for that, and RoPA 1983 §39 makes no mention of withdrawals, unless it's different for parish elections?

Well, this is a curious situation. All I can do is lay out the facts of the Abbots Langley PC case from 2015 from contemporaneous notes that I made.

The result of the election to the 5-member Abbots Langley and Bedmond ward election was as follows:

Polling was postponed until 24 June following the death, after nomination, of Oldrich (John) Sedlacek, one of the Labour Party candidates. Sedlacek’s nomination paper was replaced by one in the name of Crane. All the other candidates were originally nominated for the planned election on 7 May except for Ms. Nolan who replaced Joanne V. Cox (Lab), the latter withdrawing her nomination in Ms. Nolan’s favour. (Ms. Nolan received 584 votes as one of the Labour Party candidates in the Leavesden parish ward election held on 7 May.)

It should be noted that Ms. Cox is married to the Labour “agent” (not that you can really have agents in PC elections), so I am sure that all the correct steps were taken in consultation with the Returning Officer. I would argue that in the period between nominations re-opening for the postponed poll and closing again that there is a “window” within which it would be logical and reasonable for a nominated candidate to withdraw. I would very much like to know the status of this election.

I'm detecting hints that the Lib Dems might put more effort in than back in November. I certainly hope so, we've been giving Health Concern too easy a ride, and they seem to be running out of steam lately.
