Why do Councils publish the list of Agents shortly after the close of nominations but wait until the last minute before the deadline before publishing the SOPN. Is this because they have "always done it" that way even though a candidate cannot now formally withdraw after the close of nominations? I suspect it's because the list of agents is a straightforward copy-and-paste matter, so they have that ready to go ASAP to give themselves the full 24-hour window to triple-check that the much more complicated nomination and authorisation paperwork is all in order (for example, where authorisation to use emblems/descriptions has been delivered separately or by post, and needs matching up with candidate paperwork). # But if the provisional list of candidates contains an invalid candidate then the list of agents will be incorrect. On the other hand many councils do manage to publish the SOPN within minutes of the close of nominations. Admittedly I only stood for a Parish Council but the Elections Officer at the District Council checked all the nomination papers whilst we waited and confirmed the nomination was valid.

Joe Miller has resigned as Conservative councillor for Rottingdean Coastal ward, Brighton and Hove council, and as Conservative councillor for Peacehaven West ward, Lewes council. I wonder how many people are councillors for two different district councils at the same time. It can’t be many. Double hatters are common for district and county, usually covering the same area, of course. These two wards are separated by Saltdean. I assume he lives in Peacehaven and runs a business in Rottingdean. The 2019 SOPNs showed his address as in Brighton and Hove, so it may be the other way round.

IIUC the deadline to publish the NOEA is the same as the deadline for the close of nominations but the deadline for the SOPN is the following working day (and some electoral services are under the false belief that they are required to wait until then). Hence there's often confusion over the weekend when an electoral services puts out the NOEA but not the SOPN with the party descriptions. I think this is a relic of the days when a candidate had a window to withdraw in the 24 hours post the close of nominations (and can't they still do that in the City of London) but now it's primarily a cause of server strain as everyone refreshes the website constantly and bombards the help boxes seeking the SOPN.

I think this is a relic of the days when a candidate had a window to withdraw in the 24 hours post the close of nominations (and can't they still do that in the City of London) but now it's primarily a cause of server strain as everyone refreshes the website constantly and bombards the help boxes seeking the SOPN. I think you may have an overenthusiastic understanding of the word "everyone"

Is this not the same scenario as the Weymouth West vacancy from 2017/18? The councillor resigned on 20 Dec 2017, within 6 months of the end of their term; after the reorganisation S.I. was passed, the vacancy became active again and a by-election was held on 3 May 2018.

Indeed so, the precedent has been set there. I must admit to finding the Harrogate RO's reasoning rather difficult to follow. The wording of the relevant bit of the Structural Changes Order is (article 14(1)): I wonder if the Harrogate RO's argument is that (a) they can't fill the vacancy at an ordinary election on 5th May because there isn't going to be one; and (b) they can't extend the late councillor's term of office to allow a by-election on the grounds that he wasn't a serving councillor when the order came into force?
