I don't know whether it's ever happened in a single-seat by-election. It would, I think, require a majority to have left the winner's column blank, without even a last place “vote”. A similar situation did occur in the Pentland Hills ward in Edinburgh in the regular council elections of 2022. After Stage 8, Fiona Glasgow of the SNP, with 1840 votes, was the only remaining candidate for the one remaining seat. She should therefore have been declared elected under Rule 53. But as she had not achieved the quota of 2218, a bogus Stage 9 was recorded. Following this, she had 1994 votes, still well short. Non-transfers totalled 2438. However, she was now declared elected.
