1) if the fact is committed without the woman's consent;
2) if the offender engages in illegal practices or acts for profit;
3) if the pregnant woman dies or suffers a serious injury as a result of the abortion.
Third degree imprisonment combined with fourth degree interdiction applies if the guilty person exercises a health profession.
Art. 154 Abortion for reasons of honor
A pregnant woman who causes an abortion or allows it for reasons of honor is punished with first degree imprisonment.
Anyone who participates in the crime for profit is punished with second degree imprisonment.
If the co-participant exercises a health profession, the relative fourth degree interdiction also applies.
