Cllr. Bowden (Ind, Heath on Cardiff) has announced on Twitter that she intends to stand down next month as a councillor on Cardiff and the reason for standing down and not retiring when the six month rule kicks in was to allow Heath to have three councillors and not two. I am not sure however what the rules state about whether Cardiff has to call a by-election during the six month rule

Bizarre timing. Although will be interesting if a by-election occurs. The ward is currently split Indi/Lab/Con and Cllr Bowden herself was elected as a Lib Dem back in 2008 day alongside two Conservatives.

To answer Harry Hayfield above, my understanding is that public notice shall be given by the local authority as soon as practicable after the date on which the vacancy is deemed to have occurred (whether by resignation, death or disqualification). It is then for two local government electors anywhere in the local authority (not necessarily in the particular ward) to give notice in writing to the proper office of the authority. The Returning Officer must fix the day of election within 42 days of receiving the notice.
Neither the council, nor political parties have the power to call or suppress an election, although in practice one political party or another may organise two of its electors to give the formal notice in writing.
The six-month rule kicks in from the date on which the vacancy occurs. So if two local government electors somewhere in Cardiff gave notice re the Heath vacancy at the beginning of January, the Returning Officer would be obliged to call the election within 42 days, notwithstanding that another election was scheduled for 5 May.

Yes. The key date in the six month rule is the date on which the vacancy occurred. See Local Government Act 1972 s. 89 (3): "Where a casual vacancy in any such office occurs within six months before the day on which the councillor whose office is vacant would regularly have retired, an election shall not be held". And s. 87 defines the date on which the vacancy occurs as being the date the previous councillor died, or their resignation was received, etc.

The first time round, he didn't submit a post-dated resignation letter; he wrote a letter saying that he intended to resign on a certain date in the future. he then changed his mind before that date. Wigan Council, for reasons I have never understood (I haven't seen the full text of the relevant legal judgment*) interpreted his letter as if he had already resigned as soon as they received the letter, despite the letter saying otherwise. The council then went through the process of running a by-election for a seat which was not even vacant in the first place, thereby causing the legal kerfuffle of having to abandon the by-election part way through. * is the judgment somewhere?
